Terms of Use

These Terms of Use (the "Terms") govern your access to and use of the CHF Companion mobile application, related services, and website (collectively, the "Services"). CHF Companion is an individual educational project developed by Anna Koriakovskaia ("CHF Companion," "we," "us," or "our"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Purpose and Project Status

CHF Companion is designed to demonstrate how weight and blood pressure measurements from supported connected devices can be organized, displayed as trends, supplemented with observation notes, and included in reports.

Because the Services are part of an educational prototype, features may be incomplete, modified, suspended, or discontinued. The Services may contain defects and may not always be available. Participation in any testing or evaluation is voluntary.

2. Not Medical Advice or Emergency Monitoring

The Services provide information-management and visualization functions only. They do not provide medical advice, diagnosis, treatment recommendations, clinical monitoring, or emergency response. CHF Companion does not review measurements in real time and does not guarantee that a user, caregiver, clinician, or any other person will be notified of a concerning result.

Always consult a qualified healthcare professional regarding symptoms, measurements, medications, treatment, or changes in your condition. Never delay seeking professional advice because of information displayed by the Services. If you believe you may be experiencing a medical emergency, contact your local emergency services immediately.

3. Eligibility and Appropriate Use

You may use the Services only if you can legally agree to these Terms and your use is permitted by applicable law. The Services are not directed to children under 13, or under the higher minimum age required in their jurisdiction.

You agree to use the Services only for their intended educational and demonstration purposes and not in place of a validated clinical system, professional medical care, or emergency service.

4. Accounts and Security

You agree to provide accurate account information, keep your credentials confidential, and promptly notify us if you suspect unauthorized access. You are responsible for activity performed through your account to the extent permitted by law. You must not access another person's account or data without valid authorization.

5. Patient and Caregiver Responsibilities

If you create or manage a patient profile for another person, you represent that you have that person's valid permission or another lawful basis to do so. Caregivers and patient assistants must respect the patient's privacy, access only information necessary for the authorized purpose, and not disclose reports or health information without authorization.

CHF Companion does not verify professional qualifications, caregiving relationships, legal authority, or the identity of every person invited to access a profile. Users are responsible for choosing whom they authorize and for reviewing access when circumstances change.

6. Measurements and Connected Devices

Measurements may be supplied by supported devices and third-party providers such as Withings. Device readings, synchronization, timestamps, units, and data transfers may be delayed, incomplete, inaccurate, duplicated, or unavailable. You are responsible for using devices according to the manufacturer's instructions and for confirming important information through appropriate professional or clinical methods.

Connecting a third-party account also subjects your use of that service to the provider's own terms and policies. CHF Companion is not responsible for third-party devices, services, content, outages, or changes.

7. Reports and Sharing

Reports generated through the Services are informational summaries of available data and may not contain every measurement or relevant clinical detail. They are not medical records, diagnoses, or professional interpretations. You are responsible for reviewing a report before relying on or sharing it and for selecting recipients who are authorized to receive it.

8. Acceptable Use

You must not:

• use the Services for unlawful, harmful, fraudulent, or clinical decision-making purposes;
• submit information that you do not have the right to provide;
• attempt to gain unauthorized access to accounts, systems, or data;
• interfere with security controls or the operation of the Services;
• introduce malicious code or use automated methods that place an unreasonable load on the Services; or
• copy, modify, distribute, reverse engineer, or exploit the Services except where applicable law expressly permits it.

9. Privacy

Our Privacy Policy explains what information the Services collect and how it is used, stored, and shared. By using the Services, you acknowledge that you have reviewed the Privacy Policy. Please do not enter real patient or health information unless you are authorized to do so and understand that the Services are an educational prototype.

10. Intellectual Property

The CHF Companion name, design, software, website content, and project materials are owned by the developer or used under applicable licenses. These Terms give you a limited, personal, non-exclusive, non-transferable, and revocable right to use the Services for their intended purpose. They do not transfer ownership of any intellectual property to you.

11. Availability and Changes

We may update, limit, suspend, or discontinue any part of the Services at any time, including after the academic evaluation period. We do not promise permanent availability, data retention, compatibility with any particular device, or continued support for any integration. Where practical, we will provide reasonable notice of material changes affecting active users.

12. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided "as is" and "as available" for educational and demonstration purposes. We make no warranty that the Services will be uninterrupted, secure, error-free, accurate, complete, suitable for clinical use, or compatible with every device or third-party service. Nothing in these Terms excludes any warranty or right that cannot legally be excluded.

13. Limitation of Liability

To the fullest extent permitted by applicable law, CHF Companion and its developer will not be liable for indirect, incidental, special, consequential, or exemplary losses arising from use of, inability to use, or reliance on the Services, including loss caused by unavailable, delayed, incomplete, or inaccurate measurements or reports. You must not rely on the Services for emergency or medical decisions.

Nothing in these Terms limits liability where such limitation is prohibited by law.

14. Suspension and Account Deletion

We may restrict or suspend access when reasonably necessary to protect users, data, or the Services; address a suspected security issue; comply with law; or respond to a violation of these Terms. You may request deletion of your account by emailing chfcompanion.app@gmail.com from the address associated with your account using the subject line CHF Companion Account Deletion.

15. Changes to These Terms

We may update these Terms as the educational project, Services, or legal requirements change. We will post the revised Terms on this page and update the effective date. If a change is material, we will provide additional notice when reasonably appropriate or legally required. Continued use after the revised Terms take effect constitutes acceptance where permitted by law.

16. Governing Law

These Terms are governed by applicable law. Any mandatory consumer-protection rights and jurisdictional rules that apply to you remain unaffected. A specific governing jurisdiction may be added before any public or commercial release of the Services.
